PIOL42 hospitality agreement and general booking and stay conditions.

TOURIST HOSPITALITY AGREEMENT AND GENERAL TERMS AND CONDITIONS OF BOOKING AND STAY

1. Parties

  • This Tourist Hospitality Agreement and the present General Terms and Conditions of Booking and Stay (hereinafter the "Agreement") govern the contractual relationship between:
  • PIOL42 S.R.L.
  • Registered office: Via Fratelli Piol 42, 10098 Rivoli (TO), Italy

  • (hereinafter referred to as the "Property" or "PIOL42")
  • and
  • The individual making the booking, also on behalf of any accompanying guests listed in the booking confirmation and/or check-in form (hereinafter referred to as the "Guest" or "Booking Guest").
  • The Booking Guest declares that he/she:
  • is at least 18 years old
  • has full legal capacity
  • assumes responsibility for all accompanying guests
  • and undertakes to comply with all obligations arising from this Agreement.

2. Nature of the Service

  • PIOL42 temporarily provides the Guest and accompanying persons with a furnished accommodation unit located at:
  • Via Fratelli Piol 42, Rivoli (Turin), Italy
  • for tourism and short-term stay purposes.
  • The accommodation forms part of a holiday apartment hospitality property (CAV – Case Appartamenti Vacanze) operated by PIOL42.
  • This Agreement governs a hospitality service, not a residential lease.
  • Accordingly, the Guest:
  • acquires no tenancy rights
  • acquires no residence rights
  • may not establish domicile, residence or business premises within the property.
  • Use of the property for purposes other than temporary accommodation is strictly prohibited.

3. Accommodation Assignment and Occupancy

  • The accommodation unit assigned shall be the one indicated in the booking confirmation.
  • For operational reasons, PIOL42 reserves the right to allocate:
  • an equivalent unit, or
  • a unit of higher category.
  • Each accommodation unit has a maximum occupancy, indicated on the official website and booking confirmation.
  • Exceeding the maximum occupancy, even temporarily, constitutes a material breach of contract and entitles PIOL42 to:
  • refuse access to the property
  • terminate the Agreement immediately
  • remove unauthorized occupants
  • without any obligation to provide refunds.

4. Formation of the Contract

  • The Agreement shall be considered legally concluded once the following conditions are met:
  • the Guest submits a booking request or completes an online reservation
  • PIOL42 confirms the booking
  • the Guest accepts these Terms and Conditions
  • payment or guarantee is provided according to the selected rate conditions
  • The following documents form an integral part of the Agreement:
  • booking confirmation
  • price summary
  • house rules
  • privacy policy
  • any additional policies communicated prior to arrival.

5. Duration of Stay

  • The stay shall commence on the check-in date and end on the check-out date specified in the booking confirmation.
  • Remaining in the accommodation beyond the check-out time without prior written authorization shall be considered unauthorized occupation.
  • PIOL42 shall therefore be entitled to:
  • charge a penalty equivalent to one additional night,
  • access the accommodation to recover possession,
  • charge additional costs resulting from disruption of subsequent bookings.

6. Price, Taxes and Security Deposit

  • The price of the stay corresponds to the amount indicated in the booking confirmation.
  • Unless otherwise specified, the price does not include:
  • tourist tax (if applicable)
  • optional services
  • extra cleaning
  • early check-in or late check-out
  • pet supplements
  • damages or extraordinary costs.
  • PIOL42 reserves the right to request:
  • advance payment
  • credit card guarantee
  • security deposit
  • credit card pre-authorization.
  • The security deposit does not limit the right of PIOL42 to claim full compensation for any damage.
  • In the event of:
  • non-payment
  • payment revocation
  • chargeback
  • invalid credit card
  • PIOL42 may cancel the reservation, deny access, or terminate the Agreement without refund.

7. Cancellation Policy

  • Unless stricter policies apply through booking channels or special rates, the following rules apply:
  • Free cancellation up to 7 days before arrival
  • Less than 7 days before arrival: 100% of the booking amount will be charged
  • No-show: 100% of the booking amount will be charged
  • Early departure or late arrival: no refunds shall be granted.
  • PIOL42 may, at its sole discretion, offer vouchers or alternative arrangements.

8. Check-In and Identification

  • Check-in is permitted only after completion of the required identification procedures.
  • In compliance with Italian public safety regulations, all guests must present valid identification documents before or upon arrival.
  • PIOL42 may refuse access if:
  • valid identification is not provided
  • guest data is incomplete or false
  • payment or guarantee requirements are not satisfied
  • these Terms have not been accepted.
  • Self check-in procedures may be used where available, subject to completion of the required verification.

9. Prohibition of Subletting and Unregistered Guests

  • The Guest shall not:
  • transfer the booking to third parties
  • sublet the accommodation
  • allow overnight stays by unregistered persons
  • use the premises for commercial, promotional, professional, or audiovisual activities without written authorization.
  • Violation of this clause constitutes serious contractual breach and may result in:
  • immediate termination of the stay
  • removal from the property
  • a contractual penalty of no less than €500, without prejudice to further damages.

10. House Rules

  • Guests must:
  • respect the property and furnishings
  • avoid disturbing neighbors or other guests
  • comply with quiet hours and safety rules
  • dispose of waste according to instructions
  • use appliances responsibly
  • secure doors, windows, and utilities when leaving.
  • The following are strictly prohibited unless authorized:
  • parties or events
  • excessive noise
  • smoking where prohibited
  • illegal activities
  • tampering with installations or safety devices.

11. Pets

Pets are allowed only if expressly authorized in the booking confirmation.

Unauthorized animals are not permitted.

Guests remain fully liable for any damage or extraordinary cleaning caused by pets.

12. Damages and Extraordinary Cleaning

  • The Guest is fully responsible for damages caused by:
  • themselves
  • accompanying guests
  • visitors
  • minors
  • pets.
  • PIOL42 reserves the right to charge the Guest for:
  • damage to property or furnishings
  • missing items
  • extraordinary cleaning
  • loss of keys or access devices
  • smoking in prohibited areas.
  • Damages may be documented through photographs, videos, reports, invoices, or expert assessments.

13. Maintenance and Service Interruptions

  • PIOL42 shall make reasonable efforts to ensure proper functioning of the property and services.
  • However, PIOL42 shall not be liable for interruptions caused by:
  • third-party services
  • unforeseen technical failures
  • utility interruptions
  • internet outages
  • force majeure events.
  • Where possible, PIOL42 may provide alternative accommodation of equal or higher category.

14. Access to the Accommodation

For reasons of safety, maintenance, inspection, or emergency, authorized staff may access the accommodation.

Whenever possible, prior notice will be given.

Immediate access without notice may occur in case of emergency or violation of house rules.

15. Termination of Stay

  • PIOL42 may refuse check-in or terminate the stay immediately in case of:
  • non-payment
  • violation of house rules
  • exceeding maximum occupancy
  • presence of unauthorized guests
  • illegal or dangerous behavior
  • refusal to provide required identification.
  • No refunds shall be due in such circumstances.

16. Limitation of Liability

  • Except in cases of gross negligence or wilful misconduct, PIOL42 shall not be liable for:
  • loss or theft of personal belongings
  • damage to vehicles
  • service interruptions beyond its control
  • acts of third parties.
  • Guests are responsible for safeguarding their valuables.

17. Force Majeure

  • PIOL42 shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including:
  • natural disasters
  • pandemics
  • fires
  • floods
  • strikes
  • governmental restrictions
  • power outages.
  • In such circumstances PIOL42 may offer rescheduling, vouchers, or partial refunds at its discretion.

18. Privacy and Data Protection

Personal data shall be processed in accordance with the Privacy Policy published on the official website and applicable European and Italian data protection laws.

Video surveillance systems, where installed, operate exclusively in common areas, never inside accommodation units.

19. Applicable Law

This Agreement shall be governed by Italian law.

20. Jurisdiction

Any dispute arising from this Agreement shall fall under the jurisdiction of the Court of Turin (Italy), without prejudice to mandatory consumer protection provisions under applicable law.

21. Acceptance

By completing the booking, the Guest confirms that they have read, understood, and accepted these Terms and Conditions in full.
